Mother bought son samurai sword online before he launched stab attack (2024)

A mother bought her son a samurai sword which he then used tolaunch a stab attack before helping him get away, a court has heard.

Nicola Kayley gifted her 16-year-old son Mustafa Mokhtar the weapon which he used to knifeBen Glasspool at least five times in a horrific assault in Southampton in October last year.

The teenager had armed himself and got into a car with his older brother, Barry Kayley, and their mother, who then drove around an estate in the city before they came across Mr Glasspool and his father Simon.

Mokhtar delivered several brutal blows to Mr Glasspool before leaving him to die in the road and fleeing the scene in the car with his mother.

Nicola has now been jailed for 31 months following the horrific attack, while Mokhtar received four years and four months detention with a three-year extended licence period and his brother was sentenced to 11 months of detention.

Southampton Crown Court heard Mokhtar was drivenaround an estate with his mother and brother and later spottedMr Glasspool and his father on the side of the road.

Upon exiting the vehicle, both boys challenged the father and son, accusing them of chasing their family with crowbars, which they denied.

The court heard Mokhtar then set about attacking Ben, delivering at least five blows on the legs, hands and upper body.

Prosecutor, Charles Gabb said the sword had been bought for Mokhtar by his mother for around $200 on the internet.

The court heard Ben then tried to run away, at which point Nicola Kayley drove closer and told her son to get in the car.

But he turned to her and said 'No Mum', delivering a final blow to his back, causing the sword to become stuck in his body.

Mokhtar, his mother and brother then got into the car and drove away, the court heard.

Ben Glasspool received treatment from paramedics and neighbours at the scene and was rushed to hospital having suffered three severed ribs and a collapsed lung during the incident.

In a statement read out in court on Friday, he said: 'I am still in a lot of pain since the incident.

'My misplaced rib is still very painful. Even just lying down in my bed I am in pain.

'The doctor has told me I may suffer these pains for the rest of my life. This makes me feel angry.

'I am still struggling to sleep. This is partly due to that pain and partly due to the material effect the incident has had on me. I believe it is always going to be in my head.'

Nicola Kayley and her two sons were later arrested but answered no comment in interview.

Mokhtar was acquitted of attempted murder following a trial in April having previously pleaded guilty wounding with intent.

Barry Kayley, now 18, pleaded guilty to conspiracy to commit affray and threatening another with an offensive weapon.

Sentencing the trio, who all lived at Bluebell Road on the city's Flowers Estate at the time of the attack, Judge Christopher Parker KC said they had left 'Ben Glasspool in the road to die'.

He told Mokhtar: 'The assault was persistent and you didn't stop even when your own mother finally came to her senses.

'You do pose a risk of serious harm to the public. You demonstrated entirely unregulated planned violence.'

Mokhtar was sentenced to four years and four months detention with a three-year extended licence period.

His brother received 11 months of detention whilst his mother was jailed for 31 months.

The judge lifted reporting restrictions preventing Mokhtar from being named following an application by the media.

He said: 'This is a very public act of violence and it seems to me the public are entitled to know.'

Barry McElduff, representing Mokhtar said his client has learning difficulties and has been diagnosed with ADHD.

He added that his 'extremely low IQ explains his levels of immaturity'.

Keely Harvey, added that her client, Nicola Kayley had been out trying to find her children at the time and that the incident was 'fast moving and it was out of control'.

'She was not really thinking about what else was going on,' she said. 'She knows that she perhaps acted on instinct rather than on good sense.'

Detective Constable Ellie Williams of Southampton's Criminal Investigation Department, who led the investigation, said: 'It is miraculous that the victim of this senseless and violent stabbing did not lose his life.

'Thanks to the rapid actions of members of the public, responding police officers and our NHS and South Central Ambulance Service colleagues, the victim survived his injuries, however he still faces lasting complications as a result of what happened to him.

'He will no doubt carry the trauma of this serious assault for the rest of his life. I sincerely hope that these convictions help him begin to move forward.'

Southampton Chief Inspector Chris Douglas said: 'Incidents of this nature are rightly and understandably concerning to members of the communities that they happen in.

'I want Southampton residents to know that knife crime is a priority for us and we are carrying out a significant amount of work in this area.

'Knife crime is not an issue that policing alone can solve, which is why we have strong links with our partnership agencies including local youth groups, Southampton City Council and charities who help us to educate young people intent on carrying a knife and start the early intervention work that underpins our communities-led policing response to knife crime.

'I would like to reassure people that when these incidents take place we work as hard as we can to bring offenders to justice and review our response so that we can continue to keep Southampton safe.'
